Montesinos testified on Monday, June 30 as a loyal subordinate to Alberto Fujimori. He began by announcing that he rejected the accusations Fujimori faces for serious human rights violations, but ended by keeping silence. First he shielded himself with the supposed secrets he must keep as an “inactive” intelligence agent, then later invoked his right to silence as a defendant being tried for the same cases.
However, during the four hours that the session lasted, Montesinos mentioned some very interesting things. For example, that he was never removed from the Intelligence Service; that his removal was “fictitious.” He also confirmed that it is possible to commit crimes for matters of state.

Montesinos se declaró el día lunes como leal y subordinado a Alberto Fujimori. Comenzó anunciando que desestimaría las acusaciones por graves violaciones a los derechos humanos que se le hacen a Fujimori pero terminó guardando silencio. Primero, se escudó en el supuesto secreto que debe guardar por su condición de agente de inteligencia “inactivo”, luego apeló al derecho al silencio que tiene por su condición de procesado por los mismos casos.
Sin embargo, durante las cuatro horas que duró la sesión, Montesinos mencionó algunas cosas más que interesantes, como por ejemplo que nunca se desvinculó del Servicio de Inteligencia y que su baja en el Ejército Peruano fue ficticia. Asimismo afirmó que es posible cometer delitos por razones de Estado.

Montesinos’ testimony ruled invalid
The Judges presiding over the human rights trial of former president Alberto Fujimori declared Vladimiro Montesinos’ testimony, given last session, invalid. The Court considered Montesinos’ conduct “damaging” for the trial, since he first agreed to testify and later abruptly invoked his right to silence.

Septuagésimo séptima sesión.- Dio su testimonio el militar en retiro Pedro Villanueva Valdivia, es Comandante General del Ejército Peruano. El testigo respondió las preguntas del Fiscal Peláz.
1. Incidentes de la Audiencia
Testimonio de Montesinos es INEFICAZ.
El testimonio de Vladimiro Montesinos, dado en la sesión pasada, fue declarado por el Tribunal que juzga a Fujimori como ineficaz. El tribunal consideró que la conducta de Montesinos fue “lesiva” para el proceso, ya que en un primer momento aceptó declarar y luego, de manera abrupta, se acogió a su derecho a guardar silencio.

Seventy-sixth session. Vladimiro Montesinos Torres decided to give his testimony instead of invoking his right to silence, in order to proclaim that Fujimori had no responsibility for the crimes he is accused of. But after the Public Prosecutor’s examination, Montesinos invoked his right to silence, concluding his testimony.
1. Vladimiro Montesinos Torres’ testimony. Montesinos responded defensively to the first questions of Public Prosecutor Antonio Peláez Bardales, calling himself a “former intelligence official” and “President Fujimori’s subordinate.” According to Montesinos, his trial for treason and consequent ban on entering military buildings for 16 years was fictitious, and said he gave his all as a military intelligence officer. The most interesting parts of Montesinos’ testimony were:

Vladimiro Montesinos said that he had participated in phone tapping since 1974, which led to the Public Prosecutor’s question, “Do you mean to say that for matters of state crimes can be committed?” Montesinos firmly responded “yes.”

Septuagésimo sexta sesión.- Dio su testimonio Vladimiro Montesinos Torres, quien en un principio rechazó su derecho a guardar silencio para manifestar que Fujimori no tiene responsabilidad por los crímenes que se le imputan, y posteriormente, Montesinos Torres decidió hacer uso de su derecho a guardar silencio.
Montesinos reconoció: por razones de Estado se pueden cometer delitos
Vladimiro Montesinos manifestó que participó en actividades de interceptación telefónica desde el año 1974, lo que generó la pregunta del Fiscal: ¿Testigo quiere usted decir qué por razones de Estado se pueden cometer delitos?, Montesinos respondió claramente: SI
